Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and Shalini Nemchand Mahajan, Shalini Nemchand Mahajan / 21today, Indis One City, KPHB, Hyderabad, India ("21today", "we", "us"), governing your use of the 21today app and website (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

The Service is intended for users aged 18 or older in India. By using it, you represent that you are at least 18, can form a binding contract, and are not barred from using the Service under any applicable law. We may refuse, suspend, or terminate access at our discretion where these conditions are not met.

21today lets you run 21-day habit "sprints", check in daily, earn in-app coins and badges, use an AI coach, and share progress with a community. We may add, change, suspend, or discontinue features at any time. We aim for high availability but the Service is provided on an as-available basis and may experience downtime, maintenance, or errors.

You sign in using your mobile number (verified by one-time code) or Google account. You are responsible for all activity under your account and for keeping access to your number and Google account secure. Notify us promptly of any unauthorised use. You must provide accurate information and keep it up to date.

• Plans. We offer a free tier and paid plans (currently Pledge, Resolve, and Unbreakable, monthly or yearly). Features and prices are shown in the app and may change prospectively.
• Free trial. New users may receive a period of full access; after it ends, unpaid accounts move to the free tier.
• Payments. Payments are processed by our third-party gateway, Cashfree. We do not store your full card or bank details. You authorise the applicable charge, inclusive of taxes (e.g. GST) where applicable.
• Renewals. Plans do not auto-renew.
• Refunds. Paid plans are non-refundable; no pro-rata on cancellation.
• Non-payment. If a charge fails or is reversed, we may downgrade or suspend paid features.

Important: Coins and in-app credit are a promotional loyalty feature. They are not money, not legal tender, not a deposit or prepaid instrument, have no cash value, and cannot be withdrawn, transferred, sold, or exchanged for cash.

• Earning & use. You may earn coins for eligible in-app actions (e.g. check-ins, streaks, referrals) subject to caps and rules we set and may change. Coins can be used only within the Service for the items or discounts we make available.
• No entitlement. Coins are granted at our discretion. We may adjust earning rates, caps, expiry, catalogue, and redemption value, or discontinue the programme, at any time, prospectively.
• Expiry & forfeiture. Coins and credit may expire and are forfeited if your account is closed or terminated, or if we reasonably suspect fraud, abuse, or manipulation.
• Referral programme. Referral rewards and any promotional wallet credit are subject to programme rules (including that a referred user is genuine, new, and completes the required actions). We may withhold or reverse rewards obtained through ineligible, self-, bulk, or fraudulent referrals. Promotional credit applies only as an in-app discount and is not redeemable for cash.

You agree not to: break the law or infringe others' rights; post content that is unlawful, harmful, hateful, harassing, obscene, defamatory, or infringing; impersonate others or misrepresent your identity; upload others' images without consent; spam, scrape, reverse-engineer, or interfere with the Service or its security; manipulate coins, streaks, referrals, or reviews; or use the Service for any commercial purpose we have not authorised. We may remove content and suspend or terminate accounts that breach these rules.

You retain ownership of the content you create (including check-in photos and posts). By sharing content on the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display it solely to operate and provide the Service (for example, showing a post you chose to make public). This licence ends when you delete the content, except for copies retained in routine backups or as required by law.

You are solely responsible for your content and confirm you have the rights to share it. We are an intermediary and do not endorse user content; we are not obliged to monitor it, but we may review and remove content or accounts at our discretion.

Not medical advice. 21today is a motivational habit tool, not a healthcare, medical, nutritional, or mental-health service. Content, plans, and suggestions (including AI-generated ones) are for general informational purposes only.

Before starting any fitness, dietary, sleep, or wellness routine, consult a qualified professional, especially if you have any medical condition, are pregnant, or take medication. You participate in any physical activity voluntarily and at your own risk, and you are solely responsible for exercising within your own limits. To the extent permitted by law, we are not liable for any injury, illness, or loss resulting from activities you choose to undertake through the Service. If you experience distress or a medical emergency, seek professional help immediately.

The AI coach uses third-party models (Google Gemini, via the Lovable AI Gateway) to generate plans and replies. AI output may be inaccurate, incomplete, or unsuitable, is not professional advice, and should not be solely relied upon. You are responsible for how you use it. Do not enter sensitive personal information into the coach. See the Privacy Policy for how coach data is processed.

The Service, including its software, design, branding, and content we provide, is owned by 21today or its licensors and protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works except as expressly allowed.

The Service relies on third parties (including Cashfree, Google, the Lovable AI Gateway, our cloud backend, and messaging providers). Your use of those services may be subject to their own terms, and we are not responsible for their acts, omissions, or availability.

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted or error-free operation, or that the Service will be secure or free of harmful components. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.

To the maximum extent permitted by law, 21today and its operator, and their respective personnel, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or coins/credit, arising out of or relating to the Service, even if advised of the possibility.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service is limited to (a) the amounts you paid us in the 12 months before the event giving rise to the claim, or (b) ₹612 (Monthly Unbreakable 51 plan for 1 year), whichever is lower.

You agree to indemnify, defend, and hold harmless 21today and its operator from and against any claims, damages, losses, liabilities, and reasonable costs (including legal fees) arising from your content, your use or misuse of the Service, your violation of these Terms or any law, or your infringement of any third party's rights.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, create risk or legal exposure, or engage in fraud or abuse. On termination, your licence to use the Service ends and unused coins/credit are forfeited. Clauses that by their nature should survive (including Sections 6, 8–15, 17–22) will survive termination.

We may modify these Terms. For material changes, we will give reasonable notice (e.g. in-app or by email) before they take effect and update the "last updated" date. Continued use after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service.

We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, outages, network or third-party-provider failures, cyber-attacks, strikes, or governmental action.

In accordance with applicable Indian law (including the Information Technology Act, 2000 and rules made under it), complaints about content or your use of the Service may be sent to our Grievance Officer:

We will acknowledge complaints within 7 working days and endeavour to resolve them within the timelines prescribed by law. Privacy-specific requests are handled as set out in the Privacy Policy.

These Terms are governed by the laws of India. The courts at Hyderabad, Telangana, India have exclusive jurisdiction. This clause does not remove any right you have to approach consumer forums under law.

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Severability. If any provision is held unenforceable, the rest remains in effect, and the unenforceable part is limited to the minimum extent necessary.
• No waiver. Our failure to enforce a right is not a waiver of it.
• Assignment. You may not assign these Terms; we may assign them to a successor (e.g. on a sale or reorganisation).
• No third-party beneficiaries. These Terms do not create rights for anyone other than you and us.
• Notices. We may give notices in-app, by email, or on the website.
